1. Who we are

This website, http://www.redhealthinnovations.com, is owned and operated by Red Health Innovations (Pty) Ltd, a private company registered in the Republic of South Africa, Registration No. 2025/231476/07

This information is provided in accordance with section 43 of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") and section 32 of the Companies Act 71 of 2008.

2. Acceptance of these terms

By browsing the Site or placing an order you agree to these Terms & Conditions, together with our Shipping Policy, Refund & Returns Policy and Privacy Policy, which form part of this agreement. If you do not agree, please do not use the Site. We may update these terms from time to time; the version published on the Site at the time you place an order applies to that order.

3. Our products

Red Health sells red-light, near-infrared and PEMF devices and related wellness products for personal, at-home use. Our products are general wellness devices. They are not intended to diagnose, treat, cure or prevent any disease or medical condition, and nothing on this Site is medical advice. Please consult a healthcare professional before use if you are pregnant, have a medical condition, take photosensitising medication, or have any concerns.

Product descriptions, specifications and images are provided in good faith and as accurately as possible. Minor variations in colour or appearance may occur.

4. Prices and payment

All prices are in South African Rand (ZAR). Red Health Innovations (Pty) Ltd is not currently registered for VAT, so no VAT is charged.

Delivery within South Africa is free of charge unless stated otherwise at checkout. The total price payable, including any delivery charges, is displayed before you confirm your order.

We accept payment by debit and credit card (Visa, Mastercard, American Express), instant EFT and PayPal. Card payments are processed by our payment service providers, Paystack and Shopify Payments, over secure, encrypted (SSL/TLS) connections that meet the Payment Card Industry Data Security Standard (PCI-DSS). Red Health does not store your full card details.

We reserve the right to correct obvious pricing errors. If a product is listed at an incorrect price, we will contact you before dispatch and give you the option to confirm the order at the correct price or cancel it for a full refund.

5. Orders and stock

An order is an offer to purchase. Your order is accepted when we send you an order confirmation email. Our products are shipped directly from our manufacturing partner; if an item becomes unavailable after you order, we will notify you as soon as possible and offer an alternative or a full refund.

6. Delivery

We currently deliver to addresses within South Africa only. Orders are dispatched with a tracking number and typically arrive within 2 to 4 weeks of payment. Full details are in our Shipping Policy. Risk in the goods passes to you on delivery; ownership passes on receipt of full payment.

7. Cooling-off period, returns and refunds

As required by section 44 of ECTA, you may cancel an online purchase within 7 days of receiving the goods, without reason or penalty, and receive a full refund within 30 days of cancellation. The only cost to you is the direct cost of returning the goods. Red Health voluntarily extends this to 14 days. Full details, including how to start a return, are in our Refund & Returns Policy.

8. Warranty

In terms of section 56 of the Consumer Protection Act 68 of 2008 ("CPA"), all goods carry an implied warranty of quality for 6 months from delivery. If goods are defective, unsafe or not fit for purpose within that period, you may return them for repair, replacement or a refund at your election. In addition, Red Health provides a manufacturer's warranty against defects in materials and workmanship: 3 years on light therapy panels and 1 year on wearables, mats and accessories. The warranty does not cover damage caused by misuse, water exposure, unauthorised repair, normal wear, or use contrary to the instructions supplied.

9. Intellectual property

All content on the Site, including text, images, logos, product names and design, is owned by or licensed to Red Health and protected by South African and international intellectual property law. You may not reproduce or use it for commercial purposes without our written consent.

10. Limitation of liability

Nothing in these terms limits any right you have under the CPA or other applicable law. Subject to that, Red Health is not liable for any indirect or consequential loss arising from use of the Site or our products, and our total liability in respect of any order is limited to the price paid for that order.

11. Privacy

We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA"). Please read our Privacy Policy.

12. Complaints and dispute resolution

If you have a complaint, please contact us first at info@redhealthinnovations.com, we aim to resolve complaints within 10 business days. If we cannot resolve the matter, you may refer it to the Consumer Goods and Services Ombud (CGSO): http://www.cgso.org.za, 0860 000 272, complaints@cgso.org.za, or to the National Consumer Commission.

13. Governing law

These terms are governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the South African courts. Nothing in these terms excludes any protection you are entitled to under the CPA, ECTA or POPIA.

14. Records

In accordance with section 43(1)(k) of ECTA, a copy of these terms and your order confirmation is emailed to you and may be requested from info@redhealthinnovations.com at any time.
